Subject: Complaint regarding physical assault and incitement by Shri Rahul Gandhi, MP.

Respected Sir/Madam,
I, Hemang Joshi, son of Shri Yogesh Bhai Joshi, Member of Parliament representing the Vadodara constituency, currently residing at 507, Garvi, Gujarat Bhawan, Akbar Road, New Delhi, wish to formally lodge a complaint regarding an incident that occurred today within the precincts of Parliament.

On 29th December 2024, at 10:00 am onwards, I, along with Shri Mukesh Rajput, Shri Pratap Rao Sarangi, and other large numbers of my fellow Members of Parliament belonging to the National Democratic Alliance (NDA), were peacefully demonstrating at the Makar Dwar entrance of Parliament. This protest was against the blatant misinformation being propagated by opposition parties, particularly by the Indian National Congress.

During this peaceful demonstration, Shri Rahul Gandhi, Member of Parliament and Leader of the Opposition in the Lok Sabha, arrived at the scene around 10:40 am to 10:45 am. Despite requests from Parliament security to take the designated entry path, Shri Rahul Gandhi, with a malicious intent to disrupt the protest and physically harm NDA Members of Parliament, ignored the instructions and forcefully barged toward the peaceful demonstrators.

Not only did Shri Rahul Gandhi and others violate the instructions of the security personnel to take a dedicated path to ensure safety concerns of the protesting MPs, he also instigated other INDI Alliance Members to proceed with force and aggression toward the NDA MPs, putting the safety of the demonstrators in jeopardy.

They intentionally used physical force to push Members of Parliament Shri Mukesh Rajput and Shri Pratap Rao Sarangi and others who were standing on the narrow stairs at the entrance. As a direct consequence of Shri Rahul Gandhi's reckless and intentional actions, knowing fully well that the persons standing on the steps could suffer severe life-threatening body injuries if they are pushed, the following injuries occurred:

1. Shri Mukesh Rajput sustained a severe injury to the back of his head.
2. Shri Pratap Rao Sarangi suffered a forehead injury, both injuries requiring immediate medical attention.

My colleague, Dr. Byreddy Siddhartha, MP, who is also a qualified doctor, immediately provided first aid to the injured individuals. I personally witnessed the incident as I was standing next to my injured colleagues and attempted to reason with Shri Rahul Gandhi and his accomplices.

Shri Rahul Gandhi's actions were deliberate, intentional, and done with malafide intention & full knowledge of the potential consequences. He not only incited his fellow Members of the INDI Alliance to act aggressively but also directly caused physical harm to my colleagues. His behavior constitutes criminal assault, incitement of his fellow companions to commit violence on peaceful protestors, and endangerment to the lives of public representatives with common intention.

Along with other members belonging to the opposition bloc, in light of the above, I kindly request you to:

1. Register an FIR against Shri Rahul Gandhi and other involved persons, who can be identified from the media coverage of electronic media & from security cameras installed in the vicinity, under sections 109 (abetment), 115 (voluntary causing hurt), 117 (voluntary causing grievous hurt), 125 (act of endangering life or personal safety of others), Section 131 (use of criminal force), 351 (criminal intimidation) & 352 (common intention) of the Bhartiya Nyaya Sanhita and any other applicable sections.
2. Conduct a thorough investigation into this incident and take immediate action to ensure accountability and prevent any such instances in the future.
